Terms of Use and Purchase Terms

These terms apply to purchases and orders made via Forever Flora's website foreverflora.se. By completing a purchase, you accept these terms. We recommend reading them carefully before placing an order.

Forever Flora AB is registered for value added tax (VAT) with the Swedish Tax Agency (Skatteverket).

2. Application and parties

These terms apply to all purchases made by private individuals and businesses via foreverflora.se.

For private individuals (consumers), applicable consumer protection legislation applies, including the Swedish Consumer Sales Act (konsumentköplagen, 2022:260) and the Swedish Act on Distance Contracts and Off-Premises Contracts (lag om distansavtal och avtal utanför affärslokaler, 2005:59), to the extent these are mandatory in the consumer's favour. If a conflict arises between these terms and mandatory consumer legislation, the consumer legislation takes precedence.

For business customers (B2B), the Swedish Sale of Goods Act (köplagen, 1990:931) applies where relevant, and these terms take precedence in full over non-mandatory legislation unless otherwise agreed in writing.

3. Ordering and formation of contract

Placing an order constitutes an offer to purchase the selected products at the prices and terms shown at the time of ordering.

The contract between you and Forever Flora AB is considered concluded once you have received an order confirmation by email. The order confirmation summarises your order, the total price including VAT and shipping, and the estimated delivery time.

Forever Flora AB reserves the right to decline an order if:

  • a product is sold out or cannot otherwise be delivered
  • an obvious pricing or description error appears on the website
  • payment cannot be verified or approved

If an order is declined, we will contact you and, where possible, offer an alternative. Any payment made will be refunded in full if delivery cannot take place.

4. Prices and value added tax

All prices on foreverflora.se are stated in Swedish kronor (SEK) and include 25% value added tax (VAT) for private individuals in Sweden.

Shipping costs are additional and are shown clearly at checkout before the purchase is completed. For orders with a total value of SEK 700 or more, free standard shipping is offered within Sweden.

Forever Flora AB reserves the right to change prices without prior notice. The price applicable to your order is the price shown at checkout at the time of ordering and confirmed in the order confirmation.

Different prices, taxes and customs rules may apply for customers outside Sweden. The buyer is responsible for any customs duties and import taxes.

5. Payment

Forever Flora AB offers the following payment methods:

  • Klarna: Payment via Klarna's services, including invoice, instalment payment and direct payment. Payments via Klarna are subject to Klarna's own terms and credit terms, which you accept when choosing Klarna as your payment method. Klarna may carry out a credit check.
  • Swish: Direct payment via Swish. Payment is registered immediately.
  • Card payment: Payment by debit or credit card (Visa, Mastercard). The card transaction is handled by a certified payment service provider. We do not store card details.

Payment is charged when the order is placed, unless otherwise agreed or required by the terms of the chosen payment method.

6. Delivery and shipping

We deliver to Sweden, Denmark, Finland and Germany. Standard delivery time for in-stock items, from the order being confirmed and payment registered, is:

  • Sweden: 1–3 business days
  • Denmark: 1–3 business days
  • Finland: 2–4 business days
  • Germany: 1–3 business days

Delivery times are estimates and may vary depending on the shipping company, season and product. For custom-made or personalised products, delivery time is communicated separately.

Shipping costs and free-shipping thresholds vary by delivery country and are shown at checkout. Current shipping information is also available in our Shipping Policy.

Risk for the goods passes to you when you, or a third party designated by you other than the carrier, takes physical possession of the goods. If you independently commission a carrier that was not offered by Forever Flora AB, the risk passes when the goods are handed over to that carrier.

The parcel is delivered to the chosen pickup point or directly to the specified address. Always collect the parcel within the specified time limit. Uncollected parcels returned to us are charged a fee to cover direct costs for shipping, return handling and administration:

  • Sweden: SEK 200
  • Denmark: DKK 160
  • Finland: €20
  • Germany: €20

If a new delivery is requested, an additional shipping cost applies.

In the event of a delayed delivery, you as a consumer have the right to withhold payment and, if the delay is material, to cancel the purchase and receive a full refund in accordance with the Swedish Consumer Sales Act (konsumentköplagen).

7. Right of withdrawal

As a private individual (consumer), you normally have the right to withdraw from the purchase within 14 days of receiving the item, without stating any reason. This follows from the Swedish Act on Distance Contracts and Off-Premises Contracts (lag om distansavtal och avtal utanför affärslokaler, 2005:59).

To exercise the right of withdrawal, you must inform us of your decision in a clear statement, by email to info@foreverflora.se or by phone at +46 (0) 79 340 58 44, before the withdrawal period expires. You may also use the Swedish Consumer Agency's (Konsumentverket) standard withdrawal form, but this is not a requirement.

The item must be returned to us without undue delay and no later than 14 days after you notified us of your decision to withdraw from the contract. You as the customer bear the cost of the return, unless otherwise agreed.

If you have handled the item more than necessary to establish its nature, characteristics and function, a deduction for diminished value may apply.

Refunds are made within 14 days of us receiving the return or receiving proof that the item has been returned, whichever occurs first. Refunds are made using the same payment method used for the purchase, unless otherwise agreed.

The right of withdrawal does not apply to:

  • products made according to the consumer's specifications or which have otherwise been clearly personalised (custom-made and personalised products)
  • goods which for health or hygiene reasons are not suitable for return and whose seal has been broken after delivery
  • gift cards

8. Custom-made and personalised products

Forever Flora AB offers products that are made or adapted specifically to the customer's requirements, including moss art, moss panels, preserved trees, plant walls, moss logos and other tailor-made solutions.

The right of withdrawal under the Distance Contracts Act does not apply to such products, in accordance with Chapter 2, Section 11, point 3 of the Swedish Act on Distance Contracts and Off-Premises Contracts (products made according to the consumer's specifications or otherwise given a clear personal character).

This means you cannot withdraw from the contract simply because you change your mind after production has begun. The right to claim under the Swedish Consumer Sales Act applies in full even to personalised products if the item is faulty or does not match the order.

We always strive to ensure that every specially designed product matches your order and our quality standard. Please contact us before ordering if you are unsure about the design, materials or colour, so we can help ensure the final result is right.

Changes to or cancellation of a personalised product normally cannot be made once production has begun. Please contact us as soon as possible if you wish to make a change.

9. Complaints and the statutory right to claim

As a consumer, you have the right to file a complaint for a faulty item in accordance with the Swedish Consumer Sales Act (konsumentköplagen, 2022:260). The right to claim applies for three years from the date of delivery.

An item is considered faulty if it does not match what was agreed, does not have the characteristics the buyer could reasonably expect, or deviates from what the seller stated about the item.

Always file a complaint as soon as you discover the fault. A complaint made within two months of noticing the fault is always considered timely. Email us at info@foreverflora.se with your order number, a description of the fault, and clear photos of the item and its packaging.

For transport damage, we recommend contacting us within 48 hours of delivery to facilitate handling the case with the shipping company. Your right to claim is not, however, affected by contacting us later.

If a complaint is approved, depending on the circumstances, we offer repair, replacement, a price reduction, or cancellation of the purchase with a refund in accordance with the Swedish Consumer Sales Act.

10. Product information and natural variation

Dried flowers, preserved plants and moss-based products are natural materials. Natural variation in shape, colour, size and texture occurs and does not constitute a legal defect, provided the product otherwise matches the order and the information provided about the product.

Images on the website are illustrative. Colour reproduction may vary depending on screen calibration. Please contact us before ordering if you have questions about the appearance of a specific product.

If you are sensitive to scent, allergens or specific natural materials, we recommend contacting us before purchase. Scent experience or an allergic reaction to natural botanical materials does not, in most cases, constitute grounds for a complaint if the product otherwise matches what was ordered.

11. Personal data

Forever Flora AB processes your personal data in accordance with the GDPR and applicable data protection legislation. Information about what data we collect, how we use it and your rights can be found in our Privacy Policy.

12. Intellectual property rights

All content on foreverflora.se, including text, images, logos, graphics, product descriptions and the website's design, is the property of Forever Flora AB or is used with the rights holder's permission. The content is protected by the Swedish Copyright Act (upphovsrättslagen, 1960:729) and other applicable intellectual property laws.

It is not permitted to copy, reproduce, distribute or use content from the website for commercial purposes without written permission from Forever Flora AB.

13. Limitation of liability

Forever Flora AB is not liable for indirect damages, consequential damages, loss of profit or other financial losses arising from a purchase, delayed delivery or a defect in the product, to the extent liability is not mandatory under the Swedish Consumer Sales Act or other mandatory legislation.

The information on the website is provided "as is." We cannot guarantee that the website will always be available or error-free, and we are not liable for damage arising from technical interruptions, viruses or other circumstances beyond our control.

Nothing in these terms limits Forever Flora AB's liability for personal injury caused by negligence, fraud, or other liability that cannot be limited under mandatory law.

14. Force majeure

Forever Flora AB is exempt from liability for delay or failure to fulfil its obligations if this is due to circumstances beyond our reasonable control, including natural disasters, extreme weather events, fire, war, pandemic, government decisions, strikes, lockouts, disruptions to transport systems or similar events.

We will notify you without undue delay if such an obstacle arises and inform you of the expected impact on delivery. If the force majeure situation lasts longer than 30 days, you as a consumer have the right to cancel the purchase and receive a full refund.

15. Changes to these terms

Forever Flora AB reserves the right to change these terms at any time. Changes are published on this page with an updated date. The terms in effect at the time of your order apply to that purchase. We recommend reading the terms each time you make a purchase.

16. Governing law and dispute resolution

These terms and the purchase agreement are governed by Swedish law. If you are a consumer resident in another EU/EEA country, this choice of law does not deprive you of any protection granted by mandatory consumer-protection provisions that apply to you under applicable law.

If a dispute arises, we encourage you to first contact our customer service at info@foreverflora.se so we can try to resolve the matter amicably.

If we cannot reach an agreement, you as a consumer have the right to turn to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN) for a free review:

A complaint to ARN must meet ARN's current requirements, including the value thresholds that apply to the relevant type of dispute. Current information is available at arn.se. Forever Flora AB undertakes to participate in ARN's review and to follow the Board's recommendations.

A dispute not resolved through ARN may be tried by a general court in Sweden. Where applicable under EU rules on jurisdiction, a consumer resident in another EU country may also bring proceedings before the courts of their country of residence.
